1. Who these Terms are between
These Terms govern the use of the ToneMate AI beta (the "Software"), the licensing service at api.tonemateai.com and the website tonemateai.com. They are between you and Daniel Ortega Ortega, an individual, email support@tonemateai.com ("I", "me"). By activating a beta licence or a free trial, or by using the Software, you accept these Terms. If you do not accept them, do not use the Software.
2. The beta
ToneMate AI is in beta: it is free, it is shared with a limited group of people and it is not finished. It may have errors, change without notice, stop working or lose data such as your local history. I may end the beta, or your access to it, at any time. I do not promise support or a release date. Taking part in the beta does not entitle you to any later paid version unless I tell you so in writing.
3. The Software
ToneMate AI is a native macOS application (macOS 14 or later) with AI-assisted writing tools: rewriting, proofreading, summarising, translation, replies, dictation and speech-to-text. The Software does not include AI models or access to AI providers. It works with local models (such as Ollama or MLX) or with cloud providers (such as OpenAI, Anthropic, Google, Mistral or xAI) that you configure yourself with your own account and API key. Any cost charged by those providers is yours.
4. Licence
I give you, free of charge, a personal, non-exclusive, non-transferable and revocable licence to use the beta on one Mac at a time. A beta licence has no fixed end date: it ends as described in section 6. You can move it to another Mac by deactivating it, in the app or by writing to me. You may not: • Resell, sublicense, share or redistribute the Software or your licence key. • Circumvent or tamper with the licence checks. • Reverse-engineer, decompile or disassemble the Software, except where the law expressly allows it despite this restriction. • Use the Software to build a competing product.
5. Activation, offline use and licence checks
Activating a licence requires an internet connection. After that, the app checks the licence when it starts, every 2 hours while it runs and when your Mac wakes up. If the app cannot connect, it keeps working for up to 7 days with the last valid check; after that, it needs to connect once. A licence stops working if it has been revoked, has expired or is active on another Mac. The data the app sends for these checks is described in the Privacy Policy.
6. Beta licences and the free trial
During the beta, free licences are the beta licences described in section 4: I issue them at your request, and they have no fixed end date. When the first stable version of ToneMate is released, the free trial starts: beta licences stop working 30 days after the release, and I will tell you the exact date by email. Those 30 days are your free trial, with no payment details and no obligation to buy, and you cannot start a second trial with the same email address. From then on, anyone new can start a free trial of 30 days from the moment it is issued, one per email address and per Mac. This plan may change. I may refuse or revoke a beta licence or a trial when I detect abuse, for example repeated requests designed to get several of them.
7. No payment
Nothing is charged for the beta and I do not ask for any payment details. The only costs you can have are those charged by the AI providers you choose.
8. Feedback
Telling me about errors, ideas or how you use the Software is voluntary. If you send me feedback, I may use it freely to improve ToneMate AI, without owing you anything for it.
9. Requirements
To use ToneMate AI you must be at least 16 years old, have a Mac with macOS 14 or later, be able to connect to the internet to activate the licence, and comply with the laws that apply to you.
10. AI providers and your content
ToneMate sends the text you process to the model you choose. With a cloud provider, your own account and that provider's terms apply to what you send it. I do not receive that text. Please read the provider's terms and privacy policy. You are responsible for the content you process, including other people's messages when you use actions such as Reply, and for using providers in line with their terms and with the law. Do not send confidential or sensitive information to a cloud model unless you are allowed to and you are comfortable with that provider's terms.
11. Acceptable use
You agree not to use ToneMate AI to: • Generate, distribute or promote illegal content. • Harass, threaten, abuse or harm any person or group. • Infringe anyone's intellectual property or privacy rights. • Break any applicable law or regulation.
12. AI-generated content
AI models can produce inaccurate, incomplete or unsuitable text. I am not responsible for the accuracy or suitability of what a model generates. Review and approve any content before you use it professionally or publicly.
13. Intellectual property
ToneMate AI, including its code, design, name and related materials, belongs to Daniel Ortega Ortega. The licence does not transfer ownership or any intellectual property rights. You keep all rights to the content you create with it.
14. No warranty and liability
The beta is provided free of charge and "as is". To the extent the law allows, I give no warranty and I am not liable for damages arising from its use, except in case of intent or gross negligence. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury, or the rights you have as a consumer.
15. Changes and ending
I may update the Software and these Terms during the beta. If a change is material, I will tell you, normally by email. You can stop using the Software at any time. When the beta or your access ends, the licence stops working at its next check. I may also revoke a licence if you seriously or repeatedly break these Terms, for example by sharing the licence key.

17. Governing law and disputes
These Terms are governed by Spanish law. If you are a consumer, you also keep the mandatory consumer protections of the country where you live, and you can bring a claim before the courts of your place of residence. For business users, the courts of Spain have jurisdiction. If you have a complaint, please write to support@tonemateai.com first. I will try to solve it within 30 days.
